The Supreme Court held that under Article 142(1) of the Constitution of India, it has the discretion to dissolve a marriage on the grounds of irretrievable breakdown when it is established that the marriage has completely failed and there is no possibility of cohabitation. The Court noted that the parties had not cohabitated since 2019 and that mediation had failed, thus justifying the dissolution of the marriage to do complete justice. The Court transferred the proceedings from the Family Court in Roorkee to the Family Court in New Delhi, emphasizing the need to avoid further ordeal for the parties involved.
