Judgment text excerpt

The Supreme Court addressed the applicability of Section 14 of the Limitation Act in the context of filing objections under Section 34 of the Arbitration and Conciliation Act, 1996, as incorporated in the National Highways Act, 1956. The Court held that the period from 20.10.2011 to 20.01.2012 should be excluded while calculating the limitation period, as there was no express provision in the Arbitration Act that excludes Section 14 of the Limitation Act. Consequently, the dismissal of the application under Section 34 as barred by limitation was set aside, allowing the appellant to proceed with their objections.
