M/S Siddamsetty Infra Projects Pvt. Ltd vs Katta Sujatha Reddy

The Supreme Court, while reviewing its earlier judgment dated 25 August 2022 under Article 137 of the Constitution, addressed the issue of whether an error apparent on the face of the record existed in the context of a specific performance claim. The Court held that the review jurisdiction was not warranted as the previous judgment did not suffer from any apparent error, thereby upholding the decision of the High Court which had partially decreed the suit for specific performance. The Court reiterated the principles governing specific performance and the conditions under which review can be sought under Order XLVII Rule 1 of the Supreme Court Rules 2013.
