The Supreme Court held that under Section 62(3) of the Electricity Act, 2003, the Maharashtra Electricity Regulatory Commission has the authority to impose reliability charges for uninterrupted power supply. The Court found that the 1st respondent's non-participation in the public hearing constituted implied consent to the charges, thus affirming the Commission's order dated 15th June 2009. The appeal by the 1st respondent was dismissed, upholding the legality of the reliability charge imposed by the Commission.
