The Supreme Court upheld the High Court's decision affirming the rejection of the appellant's writ petition challenging the recovery of House Rent Allowance (HRA) under Rule 6(h) of The Jammu and Kashmir Civil Services (House Rent Allowance and City Compensation Allowance) Rules, 1992. The Court found that the appellant failed to provide sufficient evidence to prove that he was not in occupation of the government accommodation while drawing HRA. The ruling clarified that the provisions of Rule 6(h)(iv) do not exempt the appellant from liability for HRA recovery as he occasionally shared accommodation with his father, a retired government servant.
