The Supreme Court addressed the applicability of Section 143-A of the Negotiable Instruments Act, 1881, in the context of dishonoured cheques issued by directors of a company. The Court held that the interim compensation under Section 143-A can be directed against individual directors even when the company is under moratorium as per Section 14 of the Insolvency and Bankruptcy Code, 2016. The Court set aside the Bombay High Court's order that had quashed the interim payment directive, thereby reinstating the Judicial Magistrate's order for interim compensation.
