Judgment text excerpt

The Supreme Court held that the provisions of Section 125 of the Code of Criminal Procedure, 1973 do not prevail over the Muslim Women (Protection of Rights on Divorce) Act, 1986, as the latter provides a more beneficial remedy for divorced Muslim women. The Court emphasized that the 1986 Act, being a special law, supersedes the general provisions of the CrPC. The appeal was dismissed, affirming the High Court's reduction of interim maintenance from INR 20,000 to INR 10,000 per month, as the Appellant's arguments regarding the applicability of the 1986 Act were not upheld.
