Judgment text excerpt

The Supreme Court held that the publication of a news article by the appellant did not constitute criminal defamation under Section 500 IPC, as it was made in good faith and in exercise of the Fundamental Right to Freedom of Speech and Expression under Article 19(1)(a) of the Constitution of India. The Court found the order of the Magistrate rejecting the complaint to be well-reasoned and justified, thus quashing the orders of the Additional Sessions Judge and the High Court that had reversed the Magistrate's decision. The appeal was allowed in favor of the appellant.
