Judgment text excerpt
The Supreme Court held that the publication of a news article by the appellant in his newspaper did not constitute criminal defamation under Section 500 IPC, as it was published in good faith and in exercise of the Fundamental Right of Freedom of Speech and Expression under Article 19(1)(a) of the Constitution of India. The Court found the order of the Magistrate rejecting the complaint to be well-reasoned and justified, thereby quashing the orders of the Additional Sessions Judge and the High Court that had reversed the Magistrate's decision. Consequently, all proceedings against the appellant were set aside.
