Judgment text excerpt

The Supreme Court overturned the High Court's decision to quash FIR No.04797769 for offences under Sections 420, 467, 468, and 471 IPC, holding that the existence of civil proceedings does not preclude criminal prosecution for forgery and fraud. The Court established that criminality can be made out in cases involving forged documents, and the initiation of criminal proceedings is not an abuse of process merely because a civil suit is pending. The Court reinstated the FIR, allowing the criminal proceedings to continue.
