The Supreme Court held that the provisions of Section 378(5) of the Code of Criminal Procedure (CrPC) are self-contained regarding the limitation period for filing an appeal against acquittal, and thus Section 5 of the Limitation Act does not apply. The Court found that the Delhi High Court erred in condoning the delay of 72 days in the appeal against acquittal filed by the Directorate of Revenue Intelligence. Consequently, the appeal was dismissed, reaffirming that the High Court lacks the power to condone such delays under the specific provisions of the CrPC.
