Judgment text excerpt

The Supreme Court analyzed the validity of an oral gift made under Section 122 of the Transfer of Property Act, 1882, and the conditions attached to it. The Court held that the plaintiffs, as heirs of the donor, failed to prove that the gift was conditional upon the donees rendering services, and thus the gift did not revert to them upon the cessation of such services. The High Court's decision to dismiss the plaintiffs' suit on grounds of limitation and lack of evidence was upheld, affirming the defendants' possession since 1953.
