Judgment text excerpt
The Supreme Court held that under Section 19 of the Prevention of Corruption Act, 1988, a court cannot reverse a finding or sentence due to absence or irregularity in sanction unless it results in a failure of justice. The Court found that the High Court erred in acquitting the accused on the grounds of sanction, as the prosecution had sufficiently established the demand and acceptance of bribe under Sections 7 and 13(1)(d) r/w 13(2) of the Act. The Supreme Court set aside the High Court's judgment and restored the conviction of the accused.
