Judgment text excerpt

The Supreme Court held that the age of superannuation for the appellant, who was appointed as Director in 1998, should be governed by the revised AICTE and UGC regulations that increased the age limit to sixty-five years, as per the notifications dated 22.01.2010 and 18.09.2010. The Court found that the dismissal of the appellant's writ petition by the High Court was erroneous, as it failed to consider the binding nature of the revised regulations. Consequently, the Court set aside the High Court's decision and ruled in favor of the appellant, allowing him to continue in service until the age of sixty-five.
