The Supreme Court upheld the findings of the lower courts that the parties involved are governed by Hindu law under the Hindu Succession Act, 1956 (HSA, 1956). It was determined that since Mardan died prior to the enactment of the HSA, his daughters had no rights to inherit the property, which passed to Puni Ram, the father of the plaintiffs. The Court affirmed the lower courts' decisions that the defendants had no ownership rights over the disputed property originally belonging to Mardan.
