The Supreme Court upheld the decision of the Patna High Court regarding the appellant's pay fixation and pension calculation under the Bihar Pension Rules of 1950. The Court found that the promotion granted to the appellant as Assistant District Supply Officer (ADSO) on 10th March 1991 became ineffective after 1st January 1996 due to the Government Resolution dated 8th February 1999, which abolished time-bound promotions. Consequently, the appellant's pension was correctly calculated at 50% of the average emoluments based on the revised pay scale, and the recovery of excess payment was justified under the relevant rules.
