The Supreme Court held that the Lieutenant Governor of Delhi must act according to the aid and advice of the Council of Ministers when nominating members to the Delhi Municipal Corporation under Section 3(3)(b)(i) of the Delhi Municipal Corporation Act, 1957. The Court emphasized that the discretion of the Lieutenant Governor is limited and must align with the principles established in Article 239AA(4) of the Constitution. The nominations made by the Lieutenant Governor on 03.01.2023 were quashed as they were not in accordance with the required constitutional provisions.
