Judgment text excerpt

The Supreme Court held that the Rajasthan High Court erred in declaring the decree dated 09.05.1979 as inexecutable and a nullity under Section 47 of the Code of Civil Procedure, 1908. The Court established that a compromise decree, once passed, cannot be set aside without proper legal grounds, and the objections raised by the Decree Holder should have been considered valid. Consequently, the Supreme Court set aside the High Court's order and restored the Executing Court's decision, allowing the execution of the decree.
