Judgment text excerpt

The Supreme Court addressed the jurisdiction of courts to entertain applications under Section 9(1) of the Arbitration and Conciliation Act, 1996 after the constitution of an Arbitral Tribunal. The court clarified that it has the power to entertain such applications and discussed the interpretation of 'entertain' in Section 9(3). It also held that the court is not obliged to assess the efficacy of remedies under Section 17 before granting relief under Section 9(1).
