The Supreme Court held that the High Court's decision to set aside the minutes of the Zila Panchayat meeting on the grounds of violation of secrecy of ballot was erroneous. The Court emphasized that Section 28(8) of the Uttar Pradesh Kshettra Panchayat and Zila Panchayat Adhiniyam, 1961 and the Uttar Pradesh (Zila Panchayats) (Voting on Motions of Non-Confidence) Rules, 1966 mandate that voting must be conducted by secret ballot. The Court reinstated the motion of no confidence passed on 25th October 2018, affirming the principle of secrecy in voting as essential for electoral integrity.
