Judgment text excerpt

The Supreme Court upheld the MACT's award of Rs. 12,55,000 as compensation to the dependents of Harish Singh Arya, who died in a motor vehicle accident. The Court confirmed the calculation of loss of dependency based on the deceased's annual income of Rs. 1,00,000, applying a multiplier of 16 and deducting 1/4th for personal expenses. The Court rejected the High Court's erroneous assumption that the deceased was a government servant and affirmed the liability of the insurance company for the compensation awarded.
