Judgment text excerpt

The Supreme Court overturned the High Court's conviction of the appellant under Section 2(1a)(f) and Section 16(1A) of the Prevention of Food Adulteration Act, 1954, for selling adulterated Haldi Powder and for selling without a license. The Court found that the prosecution failed to establish that the sample was 'unfit for human consumption' or 'insect infested', as required by Section 2(1a)(f). The Court held that the benefit of doubt must be given to the accused due to lack of evidence regarding sample tampering and the absence of a definitive public analyst report, thus acquitting the appellant of all charges.
