Judgment text excerpt

The Supreme Court addressed the validity of a gift deed executed by Muniswamappa, which prohibited alienation of the property by the donee, N. Revanna. The Court held that the sale deeds executed by N. Revanna in favor of defendants 2 to 5 were void as they violated the conditions of the gift deed under Section 123 of the Transfer of Property Act, 1882. The Court affirmed the plaintiffs' claim of ownership, ruling that they, as great-grandsons of Muniswamappa, retained rights over the property, thus allowing the appeal and setting aside the alienations.
