The Supreme Court upheld the validity of the Circular dated 21st January 2009 issued under the Foreign Trade (Development and Regulation) Act, 1992, clarifying the Vishesh Krishi Upaj Yojna scheme. The Court ruled that the Circular is consistent with the Foreign Trade Policy 2006-2007, which excludes certain exports from duty credit entitlement, including those made by Export Oriented Units (EOUs). The appeal was dismissed as the Circular was found to be within the powers of the Executive and did not contravene the statutory provisions of the Act.
