Judgment text excerpt

The Supreme Court held that under Order VII Rule 1 of the Code of Civil Procedure, 1908, a plaint must clearly state the facts constituting the cause of action. The Court affirmed that the original plaintiff, as the absolute owner of the schedule property, was entitled to seek eviction of the original defendant, who was a licensee, and had violated the terms of the license by attempting to lease the property. The Court directed the defendant to vacate the property and remove the temporary structure, thereby upholding the plaintiff's ownership rights.
