The Supreme Court referred significant questions regarding the authority of the State of Uttar Pradesh to fix the State Advised Price (SAP) for sugarcane under the U.P. Sugarcane (Regulation of Supply and Purchase) Act, 1953, in light of Article 246 and Schedule VII of the Constitution. The court noted a conflict between previous judgments, specifically Ch. Tika Ramji & Others vs. The State of Uttar Pradesh and U.P. Cooperative Cane Unions Federations vs. West U.P. Sugar Mills Association, and proposed that a larger bench consider whether the State's power to fix SAP is arbitrary and if it conflicts with Central legislation under the Essential Commodities Act, 1955. The matter was referred to a larger bench for resolution of these constitutional and legislative issues.
