The Supreme Court held that the Appellant, having been promoted to the substantive rank of Lt. Colonel (TS) as per the order dated 15.10.1991, is entitled to pension applicable to that rank despite falling short of the 21 years of reckonable service as per Army Order dated 20.03.1990. The Court emphasized that the order promoting the Appellant was not withdrawn and thus should be honored. The appeal was allowed, and the Respondents were directed to grant the Appellant the pension corresponding to the rank of Lt. Colonel (TS).
