Judgment text excerpt

The Supreme Court examined the High Court's rejection of an application under Section 11 of the Arbitration and Conciliation Act, 1996, on the grounds of limitation. The Court held that the limitation period for invoking arbitration begins from the date of the dispute, which was triggered by the notice of demand issued on 29.05.2013, and not from the date of the notice for arbitration. Consequently, the Court found that the application was not barred by limitation and directed the High Court to appoint an arbitrator as per the arbitration clause in the agreement.
