The Supreme Court addressed the entitlement of employees who resigned before the implementation of the Life Insurance Corporation of India (Employees) Pension Rules, 1995, which were made applicable retrospectively from 1.11.1993. The Court held that employees who resigned after 1.1.1986 but before the pension scheme was notified are not entitled to the benefits of the Pension Rules, as they had voluntarily resigned and were not in service at the time the scheme came into effect. The matter was referred to a larger bench due to divergent judicial views on this issue.
