The Supreme Court held that the Memo dated 16.07.2002, which allowed the training period of LDCs to be counted for seniority in promotions to UDCs, was inconsistent with Regulation 26 of the AP State Electricity Board Service Regulations. The Court affirmed the decision of the Single Judge that executive instructions cannot override statutory regulations. Consequently, the Court upheld the need for an integrated seniority list based on Regulation 26, rejecting the appeals against the Single Judge's ruling.
