The Supreme Court upheld the decision of the Allahabad High Court which quashed the order of the Lucknow Development Authority (LDA) regarding the imposition of development charges under Section 17 of the Uttar Pradesh Urban Planning and Development Act, 1973. The Court found that the LDA failed to demonstrate any development activities in the vicinity of the land in question, which is a prerequisite for imposing such charges. Consequently, the LDA was held liable for costs amounting to Rs. 1,00,000, to be recovered from the responsible authorities.
