Judgment text excerpt

The Supreme Court upheld the validity of Rule 6(4)(m)(i) of the Karnataka Sales Tax Rules, 1957, affirming that the condition of 'use in the same form' restricts deductions under Section 5B of the Karnataka Sales Tax Act, 1957. The Court found that the appellant's use of timber and other materials in a manufactured form for interior decoration did not meet the criteria for deduction as stipulated in the Rule. Consequently, the appeal was dismissed, affirming the High Court's decision that the Rule is constitutionally valid and applicable to the appellant's case.
