Judgment text excerpt

The Supreme Court held that Rule 5A(3) of The Bihar Civil Service (Judicial Branch) (Recruitment) Rules, 1955, which allows only 10% of candidates to qualify for the final examination, violates the precedent set in Malik Mazhar Sultan v. Uttar Pradesh Public Service Commission, (2008) 17 SCC 703, which mandates a 1:10 ratio based on available vacancies. The Court emphasized that the recruitment process must adhere to the specified ratio for Civil Judge (Junior Division) positions. Consequently, the Court ruled that the application of Rule 5A(3) is invalid and must be revised to align with established legal principles.
