The Supreme Court held that under Section 31 of the Code of Criminal Procedure, 1973, a Magistrate must specify whether sentences for multiple convictions run concurrently or consecutively. The Court found that the Judicial Magistrate failed to comply with this requirement when convicting the appellant under Sections 279 and 304-A of the IPC. Consequently, the Court modified the order to ensure the sentences run concurrently, thereby allowing the appeal.
