Judgment text excerpt

The Supreme Court addressed the interpretation of Section 3(1)(b) and (c) of the Citizenship Act, 1955, clarifying the eligibility criteria for inclusion in the National Register of Citizens (NRC) concerning descendants of D Voters and Declared Foreigners. The Court held that for individuals born before 3 December 2004, if one parent is eligible for NRC, the child may be included, while for those born after this date, both parents must be eligible, and any DV or DF status disqualifies the child. The Court also sought clarification on the validity of orders under the Illegal Migrants (Determination by Tribunal) Act regarding their acceptability in NRC applications.
