Judgment text excerpt

The Supreme Court examined the validity of land transfers made by beneficiaries of agricultural land grants to the appellant, under The Karnataka Scheduled Castes and Scheduled Tribes (Prohibition of Transfer of Certain Lands) Act, 1978. The Court held that the transfers were invalid as they violated the non-alienation clause for a period of fifteen years stipulated in the grant conditions and Rule 9(i) of the Karnataka Land Grant Rules, 1969. The Court emphasized that any alienation without the requisite permission from the Deputy Commissioner, as mandated by Section 4 of the said Act, is impermissible, thereby upholding the annulment of the transfers by the competent authority.
