The Court found that the High Court erred in issuing a mandamus to fill 97 vacancies, including those arising subsequently during the life of the rank list, as the employer has discretion not to fill all requisitioned vacancies for valid reasons. The Court set aside the High Court's orders and allowed the appeals.
