Judgment text excerpt

The Supreme Court held that the appellant, whose compulsory retirement was set aside, is entitled to have his service treated as continuous from the date of retirement (08.10.2004) to the date of reinstatement (28.11.2007) for all purposes, except for actual wages. The Court emphasized that while the appellant did not work during this period, the legal effect of the order necessitates recognition of continuity in service. Consequently, the appeal was disposed of in favor of the appellant, granting him the service benefits accordingly.
