Judgment text excerpt

The Supreme Court held that the Madhya Pradesh Samaj Ke Kamjor Vargon Ke Krishi Bhumi Dharakon Ka Udhar Dene Walon Ke Bhumi Hadapane Sambandhi Kuchakron Se Paritran Tatha Mukti Adhiniyam, 1976 (M.P. Adhiniyam 1976) does not apply retroactively to transactions executed prior to its appointed date of 1st January 1971. The Court emphasized that the High Court erred in requiring proof of land holdings under Section 4 of the M.P. Adhiniyam 1976 for a transaction dated 23rd November 1953. Consequently, the Supreme Court set aside the High Court's order and restored the District Collector's decision, affirming the nullification of the sale deed and the return of possession to the appellants.
