The Supreme Court held that the 1998 Scheme and its 2001 amendment, which restrict private operators from operating non-air conditioned buses in U.T. Chandigarh, must yield to the Reciprocal Agreement of 2008 that allows for counter-signatures on permits. The Court found that the Division Bench of the High Court erred in not recognizing the relevance of the 2008 Agreement, which permits such operations under specific conditions. Consequently, the Court ruled in favor of the appellant, allowing them to operate their stage carriages in Chandigarh as per the terms of the 2008 Agreement.
