Judgment text excerpt

The Supreme Court addressed the validity of a Will executed by Nandlal Das on 12th April 1963, which was contested on grounds of revocation by a subsequent deed dated 15th October 1963. The Court held that the revocation must be established by clear evidence, and the mere execution of a later Will by Shyama Sundari Dassi does not automatically invalidate the earlier Will unless the revocation is proven. The Court ultimately upheld the original Will, affirming the Probate granted by the High Court.
