The Supreme Court addressed the validity of certain clauses in the Telecommunication (Broadcasting and Cable) Services Interconnection Regulations, 2017, and the Tariff Order, 2017, under the Telecom Regulatory Authority of India Act, 1997. The Court held that TRAI does not possess the authority to regulate the content of broadcasts, as this exceeds its jurisdiction limited to the 'means of transmission'. Consequently, several clauses regulating pricing and bundling of television channels were struck down as unconstitutional and beyond TRAI's powers.
