The Supreme Court upheld the High Court's decision that the punishment imposed on the appellant was harsh and disproportionate, violating Articles 14, 16, 19, and 21 of the Constitution of India. The Court quashed the order dated 30.05.2007 issued by the Deputy Secretary, Water Resources Department, Jharkhand, and directed the authority to reconsider the quantum of punishment within eight weeks, without reopening the disciplinary proceedings. The appeal was disposed of accordingly.
