Judgment text excerpt

The Supreme Court allowed the appeals against the Bombay High Court's order which upheld the Industrial Tribunal's award under Section 10 of the Industrial Disputes Act, 1947. The Court found that the High Court had committed a factual error in its assessment of the submissions made by the employer regarding the improper wording of the reference and the Tribunal's scope of authority. Consequently, the Court remanded the case back to the High Court for a fresh decision on the merits of the writ petitions.
