Judgment text excerpt

The Supreme Court allowed the application under Section 10-A of the Divorce Act, 1869, dissolving the marriage between Dr. Benoy Idicula Babu and Dr. Nisha Saira Benoy by mutual consent following a successful court-assisted mediation. The Court ruled that the permanent alimony of Rs. 1.25 crore paid by the husband shall not be treated as income for income tax purposes. All related cases pending in various courts were disposed of or quashed, and the Court appreciated the efforts of the mediators and counsel involved.
