The Supreme Court held that under the Certified Standing Orders framed under the Industrial Employment (Standing Orders) Act, 1946, an employee's resignation becomes effective after 30 days without the need for acceptance by the employer. The Court ruled that Air India Ltd. could not decline to accept the resignation as the appellant had completed the requisite notice period. The appeal was allowed, overturning the High Court's dismissal of the writ petition, affirming the appellant's cessation of employment as of 1st October 2006.
