The Supreme Court held that the appellant, a driver who suffered an amputation of the right leg, is entitled to 100% functional disability benefits as established in K. Janardhan v. United India Insurance Company Limited (2008) 8 SCC 518. The Court rejected the Insurance Company's argument against applying the 2009 amendment, citing Kalema Tumba v. State of Maharashtra (1999) 8 SCC 257. The Court awarded a compensation of Rs.10 Lacs to the appellant, to be paid within three months, with interest at 12% per annum if delayed.
