The Supreme Court held that Section 4(3) of the Uttar Pradesh Ministers (Salaries, Allowances and Miscellaneous Provisions) Act, 1981, as amended in 2016, is valid and does not conflict with the provisions of the Act. The Court struck down the U.P. Ex-Chief Ministers Residence Allotment Rules, 1997, on the grounds that they were ultra vires Article 14 of the Constitution and repugnant to the 1981 Act. The Court emphasized that former Chief Ministers should not receive special accommodation privileges post-tenure, aligning their treatment with other constitutional office holders.
