Judgment text excerpt

The Supreme Court held that the appellant, having rendered continuous service as defined under Section 2(e) and Section 2A of the Payment of Gratuity Act, 1972, is entitled to gratuity despite being a daily wager for a significant portion of his service. The Court found that the High Court's dismissal of the appellant's claim was unjustified, as the appellant had completed over 25 years of service, qualifying him for gratuity under the Act. Consequently, the Supreme Court set aside the High Court's orders and ruled in favor of the appellant.
