Judgment text excerpt

The Supreme Court held that under Section 166 of the Motor Vehicles Act, 1988, the heirs of the deceased are entitled to compensation for loss of dependency, which must include an addition for future prospects as established in National Insurance Company Ltd. v Pranay Sethi (2017) 16 SCC 680. The Court found that the High Court erred in not granting this addition and recalculated the total compensation to Rs 6,41,200, with interest at 9% per annum from the date of the petition. The appeal was allowed, and the previous compensation awarded by the High Court was modified accordingly.
